The family of a man who was left permanently disabled after he was shot in the head during a road rage encounter in New Jersey, allegedly by an off-duty New York City police officer, has filed a lawsuit arguing that the officer was an alcoholic who should not have been carrying a gun.

NEW YORK (WABC) -- The family of a man shot by an off-duty NYPD officer in a case of road rage announced they filed a lawsuit on Wednesday. The family of Kishan Patel is suing the officer, New York City and Mayor Eric Adams -- among others.

This case is a product of the way the police department has conducted itself over the years and this is the tragedy that ultimately was going to happen,” the family’s lawyer said.
