Coming off an armful of big Emmy wins earlier this month, Baby Reindeer and Netflix took a big hit today as a federal judge ruled the big bucks defamation case against the dark comedy and the streamer will go forward.

In June, Harvey sued Netflix for then-$50 million, claiming “defamation, intentional infliction of emotional distress, negligence, gross negligence, and violations of Harvey’s right of publicity, arising out of the brutal lies Defendants told about her in the television series, Baby Reindeer .”

Netflix moved to dismiss the lawsuit under California’s anti-SLAPP law, which allows for the early dismissal of lawsuits intended to chill free speech. The court, however, found that Harvey has a “probability of prevailing” on allegations over defamation.
